By subscribing to Pack Mule Dumpsters mobile messages, you agree to the following terms:
Consent: By entering your mobile number on our website or service forms, you agree to receive marketing and/or transactional text messages (such as delivery updates, pickup coordination, and promotional offers) from Pack Mule Dumpsters. You acknowledge that consent is not a condition of any purchase.
Program Description: Messages may include updates regarding your rental status, reminders for delivery/pickup, and special offers or discounts.
Message Frequency: Message frequency varies based on your interaction with our services and active rentals.
Cost: Message and data rates may apply. Check with your mobile carrier for details.
Opt-Out: You can opt-out of receiving SMS messages at any time by texting “STOP” to the number from which you received the message. You will receive a one-time opt-out confirmation text. After that, you will no longer receive messages from us.
Help: If you are experiencing issues with the messaging program, you can reply with the keyword “HELP” for more assistance, or contact us directly via our website.
Carrier Liability: T-Mobile, AT&T, Verizon, and other carriers are not liable for delayed or undelivered messages.
The following specific terms apply to all dumpster rental services provided by Pack Mule Dumpsters. By scheduling a delivery, the Customer agrees to these terms:
Access and Ground Conditions: Customer agrees to provide adequate road or driveways to the desired place of delivery. Customer shall assume full responsibility for all damages of any kind whatsoever to any road or driveway caused by the vehicle or container. It will be left to the driver’s discretion when driving across lawns or unstable terrain as well as across sidewalks and/or driveways.
Possession and Care: Upon delivery of the container to the Customer, the container shall be deemed to be in the sole possession and control of the Customer. Customer shall have the duty to maintain and shall be solely responsible for the safety and cleanliness of the container until the container is picked up by PACK MULE DUMPSTERS.
Indemnification: Customer shall defend, hold harmless and indemnify PACK MULE DUMPSTERS, its officers, employees and agents from and against all claims, lawsuits and any other liability, including attorney fees, or injury to persons or damage to property arising out from, relating to, or connected with container while the container is in the Customer’s possession and control, including all claims, lawsuits and other liability, including attorney fees, arising from any negligence or breach of any duty by PACK MULE DUMPSTERS.
Ownership: All containers furnished by PACK MULE DUMPSTERS shall remain the property of PACK MULE DUMPSTERS and the Customer shall have no right, title, or interest in them.
Overloading and Prohibited Use: DO NOT overload the container. Customers will be charged for all overloaded containers at their equivalent tonnage rate presently being charged. In the event the container cannot be hauled due to overloading, the rubbish will be removed from the container and it will be the customer’s responsibility to clean up said rubbish. The driver reserves the right to not haul any overloaded container. If the Customer, or Customer’s employees, agents, or contractors overfill the container and such overfilling results in an overweight fine or penalty assessed against PACK MULE DUMPSTERS, Customer is responsible for such penalty or fine upon demand by PACK MULE DUMPSTERS. Customers shall not fill the container past the top edge under any circumstances. Furthermore, PACK MULE DUMPSTERS is not responsible for any damage to nearby property caused by materials falling from an overloaded or improperly loaded container; liability for such incidents rests solely with the Customer.
Placement Liability: Customer shall specify the location for the placement of the container and Customer shall be solely responsible for any property damage arising from or relating to the placement of the container. PACK MULE DUMPSTERS specifically disclaims, and shall not be liable for, any property damage arising from or relating to the placement of the container.
Compliance with Placement Laws: Customer shall abide by all applicable laws, rules, regulations and ordinances governing placement of the container. Customer shall defend, hold harmless and indemnify PACK MULE DUMPSTERS, its officers, employees and agents from and against all claims, lawsuits and any other liability, including attorney fees, arising from or relating to Customer’s violation of any applicable laws, rules, regulations or ordinances governing placement of container.
Compliance with Disposal Laws: Customer shall abide by all applicable laws, rules, regulations and ordinances governing disposal of waste. Customer shall defend, hold harmless and indemnify PACK MULE DUMPSTERS, its officers, employees and agents from and against all claims, lawsuits and any other liability, including attorney fees, arising from or relating to Customer’s violation of any applicable laws, rules, regulations or ordinances governing disposal of waste.
Payment: Unless otherwise agreed upon in writing, payment is due from Customer to PACK MULE DUMPSTERS upon delivery of container.
Legal Costs: If any action is brought by either party to enforce the terms of this contract or for the breach of this contract, the parties agree that the non-prevailing party shall pay the substantially prevailing party reasonable attorney fees, cost and disbursements incurred by the substantially prevailing party.
Prohibited Materials: Any container which is loaded with hazardous materials, tires, dirt, bricks, asphalt, concrete or heavy materials will be dumped and reloaded at the Customer’s expense. We are not responsible for loading containers.
Accessibility Fees: It is the Customer’s sole responsibility to maintain accessibility of the container at the time of delivery and pick-up. If the container cannot be delivered or picked up due to inaccessibility, the Customer will be charged a return fee. This fee will be $100 for 30-yard containers plus mileage, and $75 for 14, 20, and 25-yard containers plus mileage.
Intellectual Property The content, layout, design, data, databases, and graphics on this website are protected by United States and other international intellectual property laws and are owned by Pack Mule Dumpsters. Unless expressly permitted in writing, you may not copy, distribute, display, or perform any content from this site.
Limitation of Liability To the fullest extent permitted by law, Pack Mule Dumpsters shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the website; (b) any conduct or content of any third party on the website.

Governing Law These Terms shall be governed and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.
